We collect the data above in the following ways: directly from you when you create an account, enter a text prompt, or upload a reference image; automatically when you interact with the App (analytics and diagnostics SDKs embedded in the App); and from Apple when you choose Sign in with Apple. We use the information we collect to:

• Provide, maintain, and improve the App's features and functionality.
• Generate images by transmitting your prompts, reference images, and generation parameters to the third-party AI service described in Section 3, solely to fulfill your generation request.
• Authenticate users via Apple Sign In or email login.
• Analyze usage trends to improve user experience.
• Detect, troubleshoot, and fix bugs or technical issues.
• Communicate important updates, security alerts, and support messages.

We do not use your prompts, reference images, or generated images to train our own or any third party's machine-learning models, and we do not use them for advertising.

3. Sharing of Information, Including with Third-Party AI Services

We do not sell or rent your personal information. We may share your data only in the following cases:

• Third-Party AI Service Provider (Google): To generate images, Pictor AI sends your text prompts, any reference images you upload, and generation parameters to Google LLC via the Google Gemini API (Gemini image-generation models such as Gemini 3.1 Flash Image and Gemini 3 Pro Image). We do not send your account information, email, contacts, location, or device identifiers to Google for image generation. Google processes this data on our behalf solely to return the generated image and does not use the data to train its generally available machine-learning models, consistent with the Gemini API terms for paid services. Google's handling of this data is governed by Google's Privacy Policy (https://policies.google.com/privacy) and the Gemini API Additional Terms of Service (https://ai.google.dev/gemini-api/terms). We have confirmed that this third party provides data protections that are equal to or better than those described in this Privacy Policy.
• User Consent Before AI Processing: Before any data is sent to the third-party AI service, the App clearly informs you what data will be sent and to whom, and requires your explicit consent. You may decline, and no prompt, image, or related data will be transmitted. You can withdraw consent at any time in the App's settings, after which AI-based generation features will be disabled until consent is granted again.
• Service Providers: With trusted third-party providers (such as analytics, crash reporting, and cloud hosting) who help us operate and improve the App. These providers are contractually required to safeguard your data and may only use it to provide services to us.
• Legal Obligations: If required by law, regulation, or legal process.
• Business Transfers: In case of a merger, acquisition, or sale of assets, your information may be transferred.
• Consent to Share Consumption Data with Apple: By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

4. Data Retention

We retain your personal information only as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce agreements. Text prompts and reference images are transmitted to the AI service provider for the purpose of fulfilling your generation request and are not retained by us after the generation is complete, except where required for abuse prevention or legal compliance.

Depending on your jurisdiction, you may have the right to:

• Access, update, or delete your account information.
• Withdraw consent for data processing, including consent to share data with the third-party AI service.
• Request a copy of your data.
• Contact us to exercise these rights at: support@pictorai.app.

You can delete your account directly in the App or by contacting us.

6. Security

We implement reasonable technical and organizational measures to protect your data against unauthorized access, loss, or misuse. Data transmitted to the third-party AI service is sent over encrypted connections (HTTPS/TLS). However, no system can be 100% secure.

7. This Website

This section covers pictorai.app, our marketing website, as opposed to the App described above.

• Anonymous page counts: For every visitor, whether or not they answer the consent banner, we send Mixpanel one event per page opened: the page, its language and the referring site. Nothing is stored in your browser for this - no cookies, no local storage - and the identifier is random for each visit, so visits cannot be linked to each other or to you. Mixpanel derives an approximate location (country, region, city) from your IP address and does not keep the address; browser, operating system and device type come from the user agent.
• Analytics cookies: We use Firebase Analytics (Google) and Mixpanel to understand which parts of the site people use - page views, clicks on the App Store link, and which example images get opened. This runs only after you press Accept in the consent banner: then Mixpanel keeps a random identifier in your browser's local storage so return visits can be recognised, and Firebase sets its cookies. Decline, and the Firebase script is never loaded and only the anonymous page counts above are sent.
• Your choice is stored locally: The Accept or Decline decision is kept in your browser's local storage so we do not ask again. Clearing site data brings the banner back.
• No accounts or forms: The website does not ask for an email address, does not create an account, and does not process payments. Those happen inside the App and in the App Store.
• Withdrawing consent: Clear this site's data in your browser settings and choose Decline when the banner reappears.

8. Children's Privacy

Pictor AI is not directed to children under 13 (or under the minimum age required by local law). We do not knowingly collect personal data from children.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted within the App with the "Effective Date" updated. Continued use of the App means you accept the revised Policy.
